WAIVER AND RELEASE OF ALL CLAIMS

Please read this form carefully and be aware that by participating in Mountainside’s (“Mountainside”) virtual “Sober Curious 101” course (the "Course") you will be expressly assuming legal liability and waiving and releasing all claims for injuries, damages or loss which you might sustain as a result of your participation in the Course.

NO TREATMENT DISCLAIMER CLAUSE

You understand that the Course relates to being sober curious. You acknowledge that any information provided during the Course by representatives of Mountainside or other participants, and any discussions related thereto, is for informational purposes only. This information is not intended to be, nor should it be interpreted to constitute or substitute for professional medical advice. No clinician-patient relationship is created by virtue of an individual’s participation in the Course. Participants should not rely or act on any information from the Course without seeking the advice of a medical professional. Participants should consult a medical professional or other health care provider if they need medical advice, diagnosis or treatment.

Neither Mountainside (nor its officials, managers, owners, affiliates, directors, agents, employees, volunteers, representatives, successors and assigns is responsible for with well-being of, or any injury, loss or damage of any kind sustained by, any participant associated with the use of, or reliance on, information obtained during the Course. You agree to hold Mountainside and its officials, managers, owners, affiliates, directors, agents, employees, volunteers, representatives, successors and assigns harmless and waive any liability for any information provided and any decisions you may make related to this information and its use.

In addition, any monies paid for the Course are non-refundable upon registration. Monies will not be refunded if a participant withdraws from the Course after registration has been completed. Participation in the Course is at Mountainside’s sole discretion. Mountainside reserves the right to remove any participant from the Course at any time at its sole discretion. Monies paid will not be refunded if a participant is removed from the Course by Mountainside. Mountainside also reserve the right to change the curriculum/content of the Course, the instructors, and the schedule at any time at its sole discretion.

In return for Mountainside allowing me to voluntarily participate in the Course, I agree:

1. TO ASSUME AND ACCEPT ALL RISKS arising out of, associated with or related to my participation in the Course;

2. TO BE SOLELY RESPONSIBLE FOR ANY INJURY, LOSS OR DAMAGE which I may sustain as a result of my participation in the Course and my use of information obtained therein;

3. TO INDEMNIFY AND HOLD HARMLESS Mountainside and its officials, managers, owners, affiliates, directors, agents, employees, volunteers, representatives, successors and assigns from any and all claims, demands, actions and costs which might arise out of my participation in the Course.

I understand and agree that this Agreement will have the effect of releasing, discharging, waiving, and forever relinquishing any and all actions or causes of action that I may have or have had, whether past, present or future, whether known or unknown, and whether anticipated or unanticipated by me, arising out of my participation in the Course. This Release constitutes a complete release, discharge and waiver of any and all actions or causes of action against Mountainside.

I understand and agree that this Agreement will be binding on me, my spouse, my heirs, my personal representatives, my successors, my assigns, my children and any guardian ad litem for said children.

I understand and agree that by signing this Agreement, I am agreeing to release, indemnify and Mountainside and its officials, managers, owners, affiliates, directors, agents, employees, volunteers, representatives, successors and assigns harmless from any and all liability or costs, including attorney's fees, associated with or arising from my participation in the Course.

I do hereby fully release and forever discharge Mountainside and its officials, managers, owners, affiliates, directors, agents, employees, volunteers, representatives, successors and assigns from any and all claims for injuries, damages, or loss that I, my family, or my guests may have or which may accrue to me and arising out of, connected with, or in any way associated with my participation in the Course.
